Regulation 2024/1689 classifies AI systems into four risk categories, each with distinct obligations.

1. Does your CRM use AI for consequential decisions about individuals? Commercial scoring = limited risk. AI scoring for hiring, credit, or access to essential services = high risk. The dividing line is the nature of the decision, not the underlying technology.
2. Are profiled individuals informed? For limited-risk systems, this is the primary obligation today. Do your terms of service or privacy policy explicitly mention AI use in the commercial profiling of contacts?
